Kim Zolciak Accuses Kroy Biermann of Fabricating Claims About Her Parenting Neglect
Real Housewives of Atlanta alum Kim Zolciak is reportedly engaged in a legal dispute with her ex, Kroy Biermann, over his allegations of her neglecting their children.
As reported in an article published by TMZ on Friday, May 22, Zolciak — who had her custody rights temporarily revoked three weeks prior — has filed legal documents asserting that the verdict was reached without key witnesses present during the proceedings.
At 47, Zolciak stated in court that a family therapist failed to appear at the hearing despite being called to testify.
According to TMZ, she also claimed that she was not given the chance to question the court-appointed lawyer, thus preventing her from exposing “Kroy’s lies and refuting” the lawyer’s custody suggestions.
Zolciak has requested that the emergency order that provisionally granted Biermann, 40, sole custody of their kids be revoked. (Zolciak and Biermann are parents to K.J., 14, Kash, 13, and twins Kaia and Kane, 12. Additionally, Zolciak has two daughters: Brielle, 29, whom Biermann adopted in 2013, and Ariana, 24, from her previous marriage to Daniel Toce.)
Us Weekly has reached out to Zolciak’s representatives for comment.
Recently, Zolciak temporarily lost physical custody of her children. According to court filings obtained by Us Weekly on May 1, a Georgia judge awarded Biermann primary physical custody of their kids.
As per the judge’s order, Zolciak and Biermann will continue to share joint legal custody, with Biermann having the final say on educational, non-emergency medical, and religious matters.
“The senior judge’s ruling from April 29 is temporary until we can return to court promptly for a full hearing,” Zolciak stated to Us at that time. “This new order resulted from an emergency motion filed by Kroy to ensure that the case was heard by a senior judge instead of our previously assigned elected judge, who has denied Kroy immediate hearings despite his filing three baseless motions against me.”
She further remarked, “The decision made by the senior judge stemmed largely from a flawed investigation conducted by a guardian ad litem who hasn’t spoken to me in over a year—except for a brief call on April 28—or my boys since April 2025, apart from a short 15-minute meeting in July 2025. I want this process resolved for my children’s sake more than anything, and I eagerly await a complete court date where we can finally present the facts.”
In April, Biermann filed an emergency motion accusing Zolciak of neglect and asserting that she is “more focused on her own image and work opportunities” than their children. He labeled her as “unstable and unfit” for parenting and called for an immediate hearing to change custody arrangements.
Zolciak and Biermann have been embroiled in a complex legal battle since Zolciak filed for divorce in May 2023. Although they briefly reconciled a few months later, the divorce proceedings resumed by August 2023.
In late March, Biermann sought sole custody of their minor children after the couple had previously agreed to joint custody, according to documents obtained by Us at the time. He contended that Zolciak’s “blatant mismanagement of basic parenting responsibilities would be unbelievable to anyone unfamiliar with the circumstances.”
In response to this filing, Zolciak stated to Us, “These accusations are entirely false and nothing more than a conscious effort by Kroy to tarnish my reputation. I dedicated five weeks to working on two TV projects to provide for my family and ensure my children are well cared for — a decision I will never regret. I refuse to be intimidated or allow falsehoods to be twisted into a narrative about my character. I will not remain silent; the truth is on my side, and it will prevail — no matter how much effort is made to suppress it.”
